Terms & Conditions
1. PAYMENT TERMS
1.1 Deposit: A deposit of twenty percent (20%) to fifty percent (50%) of the total rental amount is required to confirm and reserve the order.
1.2 Final Payment: All outstanding balances must be paid:
At least three (7) days prior to the scheduled delivery date.
1.3 Credit Card Authorization : A valid credit card must remain on file for the duration of your rental. This card may be charged for any applicable costs, including but not limited to loss, damage, cleaning fees, or late return charges. By signing this agreement, you authorize Orange County Party Rentals to process these charges on the card provided for any incidental fees incurred before, during, or after your rental period, with or without prior notice.
2. CANCELLATION POLICY
2.1 Cancellations shall be subject to the following fees based on notice provided prior to the earlier of delivery or scheduled will call:
Six (6) days or more: 25% cancellation fee.
Three (3) to five (5) days: 50% cancellation fee.
One (1) to two (2) days: 100% cancellation fee; deposit is non-refundable.
Special order items are non refundable.
2.2 Cancellations within twenty-four (24) hours of scheduled delivery or will call shall result in forfeiture of all rental fees.
3. DELIVERY, SETUP, AND PICKUP
3.1 Standard Delivery: Includes delivery one (1) day before the event and pickup one (1) day after, between the hours of 9:00 AM and 5:00 PM. High volume or peak periods may require adjusted schedules at OCPR’s discretion.
3.2 Location Requirements: Customer shall ensure that delivery locations provide clear and unobstructed access, including a minimum 4’ wide path. Additional fees may apply for:
Delivery beyond 50 feet from truck access.
More than five (5) steps, stairs, or use of elevators.
Grass, gravel, sand, or steep inclines.
3.3 Setup Services: Setup services are not included in your rental unless requested and paid for in advance. Requests must be arranged no later than 7 days prior to the delivery date. Requests made within 7 days of delivery—or on the delivery/pick-up day—will incur a fee equal to three times the standard service rate (rates available upon request).If setup is not listed on your invoice, the delivery team is not obligated to provide setup services. In such cases, all rental items will be placed at the closest accessible area to the event location listed in your order.
3.4 Breakdown Services: Breakdown services are not included in your rental unless requested and paid for in advance. Customers are responsible for leaving all rental items ready for pickup (stacked and/or returned to the provided containers) at the same location where they were originally dropped off.
If breakdown service is not listed on your invoice, the delivery team is not obligated to provide it. At the time of pickup, the delivery team may, at their discretion, either:
Break down the items to complete pickup (a last minute breakdown fee will apply, which is 3x the standard rate and charged to the card on file), or
Decline to break down items, resulting in additional daily rental and pickup fees until the rentals are collected or returned to the OCPR warehouse.
Note: Please refer to Clause 1.3 regarding OCPR’s right to charge the credit card on file for any fees incurred in connection with setup, breakdown, or related services.
3.5 Site Conditions: Customer shall ensure the delivery site is free of obstacles, properly marked, and safe for setup. Tents shall not be installed over buried utilities. OCPR is not liable for damage to facilities, property and fixtures, or personal property, and Customer accepts full responsibility for any such damage that occurs during delivery, set-up, breakdown, or event services.
3.6 Pets: Staff shall not enter areas with unrestrained pets. Customer is responsible for securing animals and cleaning up any pet waste in the setup area prior to delivery.
4. USE AND MAINTENANCE OF RENTAL EQUIPMENT
4.1 Rental items shall remain the exclusive property of OCPR. Customer shall not:
Sublease, transfer, or assign equipment without prior written consent.
Remove items from the original site without OCPR’s written approval.
Remove or tamper with identifying labels or markings.
4.2 Inspection: Equipment shall be inspected by Customer upon delivery or pickup. Any damage, malfunction, or missing items must be reported to OCPR immediately. Failure to notify promptly voids any right to refund or replacement.
4.3 Malfunctions: Customer shall not attempt to repair any malfunctioning equipment. If issues arise, Customer must immediately contact OCPR at (714) 996-3805. After-hours calls will forward to an on-call representative.
4.4 Customer Responsibility: Customer agrees to operate all rental items in a safe and lawful manner, and assumes full liability for:
Any injuries, accidents, or damages resulting from use.
Any loss, theft, or damage occurring during the rental period.
Damage from inclement weather, sprinklers, or improper use.
4.5 Outdoor Events: Customer assumes all risks associated with weather-related disruptions. Tents are temporary shade structures and not guaranteed to be waterproof. In high winds or storms, tents must be evacuated immediately.
5. RETURN AND CONDITION OF EQUIPMENT
5.1 Rental items must be returned in the same condition as received, excluding reasonable wear and tear. Additional charges will apply for:
Dishware/Flatware/Glassware not scraped and rinsed: $0.15 per item.
Concession machines/Grills not properly cleaned ($35 BBQ/Grills, $25 Concession Machines)
Linens returned wet, mildewed, excessively soiled, or damaged: full replacement cost.
Furniture and all other Equipment returned dirty and unstacked: cleaning and/or labor charges.
Late Returns: daily rental fees accrue until all items are returned.
5.2 If upon pick-up, furniture and Equipment are not properly stacked and placed in an accessible location, breakdown fees of 3x the standard rates will apply and charged to the card on file. Additional fees apply for long hauls that go beyond 50ft of distance from truck and beyond 5 steps.
5.3 Items must be protected from theft, rain, and sprinkler systems. Equipment must be stored securely and not left unattended in public spaces.
6. WILL CALL RENTALS
6.1 Customer pickups and returns are allowed:
Monday–Friday: 9:00 AM–4:00 PM
Saturday: 9:00 AM–12:00 PM
No Sunday Will Call
6.2 OCPR may assist with loading or unloading as a courtesy only. Customer assumes all risk for damage to personal property or injury. Customer is responsible for securing equipment during transit and is advised to bring blankets, straps, or tie-downs.
7. LIABILITY AND INDEMNIFICATION
7.1 Customer assumes all responsibility for rental items while in possession and agrees to indemnify, defend, and hold harmless OCPR, its officers, employees, and agents from all claims, liabilities, damages, losses, and expenses, including attorney’s fees, arising out of or in connection with Customer’s use or misuse of rental items.
7.2 Limitation of Liability: OCPR shall not be liable for any incidental, consequential, or punitive damages arising out of delays, defects, or failure of performance.
7.3 If legal action is required to enforce this Agreement, the prevailing party shall be entitled to recover its reasonable attorney’s fees and costs.
8. COMPLIANCE WITH LAW & PERMITS
8.1 Customer is responsible for obtaining all municipal, state, or federal permits and licenses unless otherwise stated in the invoice. Permit service by OCPR must be requested at least three (3) weeks in advance and will incur additional fees.
8.2 Failure to obtain permits does not relieve Customer of financial responsibility for the rental order or related obligations.
9. MISCELLANEOUS TERMS
9.1 Text Communication Consent: By providing your mobile phone number, you expressly consent to receive text message communications from Orange County Party Rentals and its representatives, regarding your order, including but not limited to delivery updates, pickup notifications, and urgent or emergency information related to your service. Message and data rates may apply.
9.2 Lost Property Policy: OCPR is not responsible for personal items, third-party rentals, or venue property left among or near our equipment. Customer must clearly separate and label non-OCPR items before pickup.
9.3 Title and Ownership: Title to all rental items remains with OCPR at all times. Customer acquires no ownership rights under this Agreement.
9.4 Entire Agreement: This document, along with the invoice and any addenda, constitutes the entire agreement between the parties and supersedes any prior written or oral representations.
ACKNOWLEDGEMENT
By signing this Agreement or submitting payment, the undersigned Customer acknowledges and agrees to be bound by all terms and conditions contained herein.
